A contract of employment arises when one party agrees to personally undertake work for another,for which they will be paid to do. This agreement can be made verbally or in writing and will usuallycontain express and implied terms. For an employment to exist there needs to be a contract of service, whereby the employer controls and decides how, where and when an employee’s work is conducted.
